WAIVER OF LIABILITY, RELEASE,
ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

This is an important legal document. It explains the risks you are assuming by beginning an exercise
program. It is critical you read and understand it completely.
In no event will Move4 (“Move4”) be liable for any direct, indirect, special, or other consequential damages resulting from your use of the Move4 studio, Move4 website (www.move4studio.com), the App, any other linked/third-party website, including without limitation, any lost profits, business interruption, loss of programs, or other data on your information handling systems or otherwise, including any claims waived by you previously in this agreement even if Move4 expressly advised of the possibility of such damage. All information is provided by Move4 LCC on an “as is” basis only. Move4 provides no representations and warranties, express or implied, including the implied warranties of fitness for a particular purpose, merchantability, and non-infringement.
Upon creating an account, you are acknowledging and agreeing to the above terms and
conditions and to the below studio, on-demand, and live streaming classes waiver of liability, release, assumption of risk and indemnity agreement. By acknowledging this document, you will have waived certain legal rights, including the right to sue.
In consideration for being allowed to participate in classes and activities operated by Move4, its
subsidiaries, affiliates, employees, instructors, independent instructors, franchisees, and agents, I hereby
understand, agree, and acknowledge on behalf of myself, my heirs, administrators, and assigns the following:
1. I will be attending classes, activities and other programs utilizing facilities and equipment and
performing exercise at Move4, on demand, and live streaming from which there are inherent
risks and dangers, which can include, but not limited to, physical injury to my legs, knees, back,
shoulders, head, injury, or strain to the cardiovascular, circulatory and/or respiratory systems and injuries to other parts of the body.
2. I agree to assume all risks related to or inherent in such participation, which may include, but
are not limited to, serious physical injury and death and shall indemnify and hold harmless Move4
from same.
3. I have no known medical or physical condition (including pregnancy), mental or emotional
disability including but not limited to cardiac irregularity, episodes of dizziness, asthma or other
breathing difficulties, diabetes, neurological disorders, spinal joint tendon or ligament injuries, high/low
blood pressure or any other disability that would put me in any physical or medical danger or prevent or limit me from attending and/or using any Move4 classes.
4. I have not been advised by a physician to limit my physical activities and I am not under the
influence of any medication or substance that would prevent such participation.
5. It is the recommendation of Move4 that I consult with a physician before participating in
classes and that my participation in such classes is purely voluntary and occurs at my own risk.
6. Any instructions and advice of instructors is not to be construed by me to be medical advice.
7. If in the opinion of Move4 my access or participation may endanger my health, Move4 may
deny me access and the right to participate until I furnish a letter from my physician stating that in the
opinion of such physician I am medically and physically able to participate in Move4 classes.
8. Move4 is not in any way responsible for the safe keeping of my personal belongings while I
attend a class and that any storage capability that is provided for my use by Move4 is strictly as
a courtesy for my own benefit and at my own risk.
9. In consideration of my right to pay for and participate in classes I execute this release and
agree to, on behalf of myself, my heirs, administrators and assigns, waive, release, hold harmless and
indemnify Move4 LLC, its employees, independent contractors, representatives, equipment
manufacturers, licensors, officers, managers, members, franchisees, and agents from any and all injuries, claims, damages and causes of action, including but not limited to Covid-19 and other infectious diseases, (“claim”) that may arise from my participation regardless of how such claim may have come about.
10. I consent and agree that Move4 may take photographs or videos of me in or using the
Move4 facilities and equipment. I agree that such photographs or videos and copies thereof may be
used by Move4.
I hereby assign all copyrights or other rights in such photographs or videos and copies thereof to Move4.
11. I have read and understand the foregoing and I have had the opportunity to have this
document reviewed by an attorney of my choice.
12. The rules and regulations of Move4 may change from time to time and my continued
participation is an acknowledgment of my agreement to such rules and regulations as they may
change from time to time.
13. This agreement and release shall remain in full force and effect for so long as I participate in
activities and classes at Move4.
14. The venue for any dispute arising from this agreement shall be in the Houston County,
Alabama and this agreement shall be governed by Alabama law.
15. In the event any portion of this agreement is deemed to be not enforceable, then it shall not
impair the remainder of the agreement.

WAIVER AND RELEASE OF LIABILITY - SHORT-TERM CHILD SUPERVISION
I, the undersigned, understand and acknowledge that Move4 is not a licensed childcare facility,
and that the temporary supervision of my child/children is a service Move4 may provide only while I am
present at the training site (“Location”) for the sole purpose of participating in Move4 training or classes
(“Training”).
I hereby grant permission for my child/children to be temporarily supervised by Move4 (including
its officers, employees, representatives, agents, contractors, volunteers, successors and assigns -
collectively, "Move4") while I participate in Training. In the event that I am injured during Training and that injury makes me unavailable or unable to attend to my child, I hereby give Move4 my express written
permission to contact the Emergency Contact listed herein and acknowledge that Move4 may release my child/children into the custody of my Emergency Contract if required.
I understand that Move4 reserves the right to decline temporary supervision of any child for any
reason, at Move4’s sole discretion. I hereby hold harmless, waive and release Move4 from any and all
liability in connection with any personal injury or property damage or loss that may occur while my child is supervised by Move4 at the Location. I agree not to sue Move4 and release all rights to make a claim against or sue Move4 in connection with the supervision of my child. I further agree to defend and indemnify the Move4 for any and all claims arising in connection with Move4’s supervision of my child.
I understand that if my child should become inconsolable or present any behavioral issues
negatively impacting any other child, children or Move4 staff during any Training, it is my responsibility to leave Training and attend my child. I understand it is my sole responsibility to inform Move4 with all
information about any allergies, sensitivities, behavioral issues my child may have that may impact my child or any other child’s health or well-being.

TERMS AND CONDITIONS

CLASS CANCELLATION POLICIES
Late Cancels - All classes (both paid and free) require a 4-hour cancellation notice. If you cancel
class within the 4-hour that is considered a late-cancel and you will be charged a fee of $6.00 or
lose a credit.
No Shows – If you fail to show up for a class you are signed up for, you will receive a $12.00 fee
or lose a credit.
Private Sessions - Require a 24-hour cancellation notice, or a $50.00 late cancel fee will be
charged. No shows are charged in full.

MEMBERSHIP CANCELLATIONS AND HOLDS
Cancellation - Auto-pay memberships require a 30-day written cancellation notice via email to
your studio. You will receive confirmation upon receipt along with your final payment date. The 30-day policy is based off your billing date.
Minimum Commitment – Memberships require a 3-month commitment unless otherwise stated.
Some memberships requiring verification expire after a set term in your agreement. At which time,
re-verification is required.
Holds - You may place your membership on hold one time per calendar year. All membership suspensions will be capped at a 3-month maximum time allowance. After the 3-month term, your membership will be re- activated. Each additional hold will incur a fee of $30.00. Exceptions include injury, new child, or illness.

WAITLIST PROGRAM
Registering for the waitlist is just like registering for a class. If your plans change, please remove
yourself from the list. You may be automatically added into class up to 1-hour before class. In the event this happens, you will be notified via email. The no show and late cancel policies above apply if you are added to class from the waitlist within the 10-hour cancellation window.

RETURN POLICY
Returns - Apparel can be returned within 30 days unworn, with original tags attached for store
credit only. This credit can only be used towards retail.
Exchanges - Retail that is unworn, with original tags attached can be exchanged if inventory
allows.
Classes and Membership - Not eligible for transfer, exchange, price adjustment, or refund.
Existing members are not eligible for future pricing changes or sales on memberships.
You may cancel your purchase of classes or membership, without penalty, within 3 days,
exclusive of holidays and weekends, by e-mailing support@Move4.com. You will receive a full refund of your purchase, less the cost of any used classes.

CLASS REQUIREMENTS
Grippy Socks - Are required for class. If you do not own a pair, we have them available for
purchase.
New Clients - If this is your first class with Move4 (“Move4”) you must arrive 15 minutes early as a rundown of our m4mer machine and room is mandatory.
Children - Move4 does not allow children under 16 years of age in the studio
Move4 does not accept personal checks.
Coaches are subject to change without notice.
All clients must agree to all conditions to take any Move4 class.
